{"id":2398,"date":"2017-07-05T14:26:01","date_gmt":"2017-07-05T18:26:01","guid":{"rendered":"http:\/\/localhost:10028\/whitepapers\/law360-uber-drivers-urge-judge-not-dismiss-case\/"},"modified":"2022-06-27T02:24:38","modified_gmt":"2022-06-27T06:24:38","slug":"law360-uber-drivers-durumu-yargilamayin-durdurmayin","status":"publish","type":"whitepapers","link":"https:\/\/napolilaw.lemonadestand.org\/tr\/beyaz-kagitlar\/law360-uber-drivers-durumu-yargilamayin-durdurmayin\/","title":{"rendered":"Law360: Uber S\u00fcr\u00fcc\u00fcleri Yarg\u0131\u00e7tan Davay\u0131 D\u00fc\u015f\u00fcrmemesini \u0130stiyor"},"content":{"rendered":"<p>Dulberg said he and Uber are currently bound by the company\u2019s Dec. 11, 2015, technology services agreement, and he insists the language of that agreement backs up his allegations that Uber took a bigger cut of passenger fares than it said it would in the agreement, according to Dulberg\u2019s brief.<\/p>\n<p>\u201cEven if the [technology services agreement] allowed Uber to charge passengers an upfront fare and that upfront fare could be different from and higher than the fare determined by the fare calculation (i.e., the only fare in the TSA, the fare that Dulberg charges and the fare on which Uber\u2019s service fee is based), Uber has still breached the TSA because Uber may deduct only its service fee \u2014 20 percent \u2018of the fare determined by the fare calculation\u2019 \u2014 before remitting the remainder of the upfront fare to Dulberg,\u201d the opposition brief said.<\/p>\n<p>Under the upfront pricing model, the ride-hailing giant charges passengers a fare before their ride even begins, but Uber bases that fare on an aggressive and often inflated projection of the distance and time involved in a particular ride, Dulberg alleged.
