In response, Evenflo proposed a fix, but did not admit fault or negligence.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In an unrelated matter, a group of parents filed a class-action lawsuit against Graco, claiming the company falsely marketed its booster seats as safe for children under four years old and under forty pounds. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2002 and again in 2010, the National Highway Traffic Safety Administration said this claim was false, according to the lawsuit. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Court documents also state that a crash dummy \u201c<\/span><a href=\"https:\/\/dockets.justia.com\/docket\/new-york\/nyedce\/1:2020cv02067\/447825\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">hurtled out<\/span><\/a><span style=\"font-weight: 400;\"> of the shoulder belt\u201d during a side-impact test.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A spokesperson for Graco\u2019s parent company, Newell Brands DTC Inc., refused to comment.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Evenflo and Defective Products<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Typically, by the time a manufacturer issues a recall, many people have already been injured. In an advertising\/misrepresentation claim, the first step is usually to establish the industry standard for these types of claims. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">There is a difference between <\/span><a href=\"https:\/\/definitions.uslegal.com\/p\/puffery\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">mere puffery<\/span><\/a><span style=\"font-weight: 400;\"> and false claims. Puffery is usually sales-y terms, like the \u201cbest\u201d something or other, which no one takes literally. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">False claims are usually one of the following:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Fraudulent misrepresentation (making a statement with knowledge of its falsity or with wilful blindness of the truth), or<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Negligent misrepresentation (making a statement without bothering to find out if it\u2019s true).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Many jurors award punitive damages in fraudulent misrepresentation claims, assuming there is evidence which satisfies the \u201cclear and convincing\u201d requirement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Generally, compensatory damages are available in fraudulent misrepresentation claims. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">These damages include compensation for economic losses, such as medical bills, and noneconomic losses, such as pain and suffering.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Car Seats and the \u201cSeat Belt Defense\u201d in New York<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The Empire State has a broad mandatory seat belt law. Car seats are a good example. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Almost two-thirds of parents do not correctly use their car seats. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Perhaps they anchor the seat improperly or perhaps the child is above or below the weight limit. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although these children are technically unrestrained, most judges would conclude that the seat belt defense does not apply, because of the parent\u2019s good faith effort to comply.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Next, the insurance company must convince jurors of the same thing. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">This showing requires expert testimony, and not all experts are created equally.
